The former cop was accused of second-degree murder, two charges of serious kidnapping, two counts of official misconduct, aggravated assault, and one crime of official oppression after the Nicolas incident. According to CNN, second-degree murder is characterized as the “knowing death of another” and is a Class A felony in Tennessee, carrying a sentence of 15 to 60 years in prison. A video of the altercation between Nichols, Bean, Smith, Martin, Mills, and Haley was made public on January 27, 2023. The five ex-Memphis Police Department officers are shown in the video being arraigned on February 17, 2023.

According to police reports, Nichols ran away on foot after being pulled over for careless driving, and when the cops attempted to hold him, there was a “confrontation.” An examination of the available camera footage and an investigation, according to Memphis Police Chief Cerelyn “C.J.” Davis, could not “substantiate” the claim of reckless driving.
