In a bold move, Florida has decided not to follow the new Title IX rules from President Biden. This decision could lead to a big fight between the state and the federal government, affecting students’ rights and education policy. Let’s dig deeper into why Florida is taking this stand and what it might mean for schools.
Florida ‘Will Not Comply’ With New Biden Title IX Rules
Governor Ron DeSantis (R) of Florida declared on Thursday that his state “will not comply” with the Biden administration’s recently revealed Title IX modifications.
In a video uploaded to the social media website X, DeSantis declared, “Florida rejects President Biden’s attempt to rewrite Title IX. We will fight back, and we will not comply.”
DeSantis went on, “We are not going to allow Joe Biden to try to insert men into women’s activities. We are not going to let Joe Biden undermine the rights of parents, and we are not going to let Joe Biden abuse his constitutional authority to try to impose these policies on us here in Florida.”

A final set of Title IX amendments that provide transgender students with protections under the federal civil rights legislation against s*x-based discrimination were revealed by the Biden administration on Friday. The adjustments will take effect in early August.
Miguel Cardona, the secretary of education, stated in a statement that “these final regulations build on the legacy of Title IX by clarifying that all our nation’s students can access schools that are safe, welcoming, and respect their rights.”
LGBTQ activists have previously attacked DeSantis for perceived harm to their community caused by state regulations, including the so-called “Don’t Say Gay” rule, which prohibits LGBTQ debate in Florida public schools.
The largest LGBTQ advocacy organization in the country, the Human Rights Campaign (HRC), collaborated with a Florida-based LGBTQ advocacy group last year to release a travel advice discouraging visiting Florida.
The travel alert from HRC and Equality Florida states that “taken in their totality, Florida’s slate of laws and policies targeting basic freedoms and rights pose a significant risk to the health and safety of many considering relocation and temporary travel to the state.”
“Already, politicians in Florida, Louisiana, Oklahoma, and elsewhere are leaping to oppose crucial protections for students in America’s schools,” stated HRC’s national press secretary, Brandon Wolf, in an email to news outlets.
Wolf said in the statement, “These MAGA politicians are choosing theatrics and hateful rhetoric over protecting and furthering the needs of their state’s students. Refusing to comply with Title IX could have damaging consequences for schools, including a significant loss in funding on the order of hundreds of millions of dollars — dollars that should be going to helping young people achieve academic excellence.”
Florida’s Commissioner of Education, Manny Diaz Jr., informed school administrators that his state “will fight” the amendments to Title IX in a memo dated Thursday.
According to Diaz’s memo, “the Biden Administration maims the statute beyond recognition in an attempt to gaslight the country into believing that biological sex no longer has any meaning, instead of implementing Congress’s clear directive to prevent discrimination based on biological s*x.”
