Georgia’s Legal System ‘Continues To Fail People Everyday,’ Especially Black Population

An opinion piece published in Newsone has said that Black people’s genuine fear of bodily injury or death due to their skin color is often disregarded.

The article written by Rev. James Woodall, a current Public Policy Associate of the Southern Center for Human Rights and former State President of the Georgia NAACP, states that the incident involving William Marcus Wilson has posed several questions on Georgia’s legal system.

Wilson, who is Black and was with a white woman during the incident that led to the death of Haley Hutcheson, has been sitting in pre-trial detention for over 400 days now. According to the article, the pre-trial immunity hearing for the man is “a living example of an ongoing and real crisis faced by the country” and comes across “as a threat for all black people residing in the country with no protection and safety.”

Wilson was initially denied bond. His legal advice filed a motion to reconsider the bond in December 2020. But still, the motion is still pending with no actions from the judge so far.

Georgia’s Legal System Under Stiff Crisis

According to the author, “innocent people like Wilson are still reliant on the judicial system for a fair judgment, but the system amazingly continues to fail its people every day – even, when they haven’t been proven guilty.”

A system that is built to protect its people and considers innocent until proven guilty has still not been able to earn justice to a young man who has been behind bars for over a year due to the non-issuance of a judge’s statement, the article says.

As far as the case involving the Black man is concerned, Wilson insists that “he was in fear for his life after a truck full of drunk, white teenagers tried to run his car off the road while screaming “N*gger/lover” at him and his girlfriend.” They also hurled empty beer bottles at Wilson’s car that could hurt him and his girlfriend during the time.

According to the author, this incident also brought to light how the whites could get away even after the influence of drunk driving with beer bottles openly in a truck. The white teenagers had also reportedly purchased alcohol bottles to bring under-aged, all of which is discerned by the law, with no actions at their end.

Wilson’s defense counsel learned about the miscommunications between Judge Michael Muldrew and District Attorney Daphne Totten during the trial. He said, “As the immunity hearing approached a close on the second day of testimony, I became horrified as basic Constitutional protections seemed to disappear right before our eyes. Protections like the right to legal counsel, due process, and judicial impartiality appeared in question.”

While they ignored the appropriate procedure to recognize the misfortune, they tried for a cover-up without informing the defense by citing judicial impropriety. Owing to this, the judge received a piece of evidence from the district attorney which Wilson’s defense was not aware of. This, when brought to the court by the defense team, Wilson’s lead defense counsel, Attorney Francys Johnson was held in contempt of court by Muldrew.

Johnson, who is a renowned civil rights advocate and attorney in the state, got detention for over 6 hours. The defense also threatened his co-counsel with contempt who rejected bailiffs’ countenance to shove Johnson. It’s a frightening incident where a judge’s action goes against his officer at the court, the article states.

Expressing concerns over the current state of Georgia and this country’s legal system, the author says that judges and prosecutors act without professional integrity because they do not expect serious accountability. “This is also the result of a failed legal system that seeks to punish people who either are unable to pay bond or are simply the victims of a legal crisis.”

There are many Judges like Michael Muldrew who should be held accountable for infringing legal rights based on their power and privileges, the article says, adding that the legal system in Georgia’s rural and coastal South is also pose threat and menace to the limping justice in the entire state.

Daphne Totten, Chief Assistant District Attorney, also stated this crisis as she shared her example of how she failed in securing an indictment in the murder of Julian Lewis. The Georgia State Patrol and the Georgia Bureau of Investigation both agreed that Lewis’ death was murder. Totten still refuses to release the video and audio of Lewis’ murder by Trooper Jake Thompson.

Former District Attorney Jackie Johnson is another example. She failed to prosecute the murders of Ahmaud Arbery. Nobody held her accountable for cases she neglected as her duties as a prosecutor.

According to the article, Georgia’s legal crisis extends even to its jails and prisons, as incarcerated people repeatedly suffer inhumane and horrific situations. Most of this can be witnessed in South and rural Georgia communities.

These are just a few of the tens of thousands of cases in which justice is never served. In every aspect of this crisis, lives and communities are being destroyed, the author states. He further says that “the failures of legal institutions persist through a lack of accountability, transparency, and clear impartiality. It’s ultimately up to us to abolish these systems and reimagine a new way.”

The article states that Wilson and many other young people “are imperiled with this never-ending judgment along with procedural delays that stands as a hindrance in the way of justice. Black people’s unpretentious anxiety of injuries or death is deplorable and obnoxious.”

It is time we stand for innocents like Wilson, and get Wilson home. It is time we speak about it, and fight for the rights of all, despite their race, color, or creed, the author concludes.
